Terms of Service

1. Introduction & Binding Agreement

Welcome to JP Logistices. These Terms of Service ("Terms") govern all freight forwarding, surface transportation, intermodal rail, coastal shipping, warehousing, and digital tracking services provided by JP Logistices via JPLogistices.com or formal commercial contracts. By booking cargo, accepting a freight quotation, or utilizing our logistics portal, you agree to be bound by these Terms.

2. Quotations, Pricing & Bookings

All quotes provided by JP Logistices are based on shipper-provided weight, volume, classification, and destination parameters:

• Transparent Invoicing: In accordance with our core promise, signed quotes reflect all standard transit and terminal handling fees. Unilateral rate changes are never applied unless cargo specifications differ upon physical weighment or customs reclassification.
• Fuel Adjustments: Fuel movement is absorbed into agreed contract rates for the duration of the contracted term.
• Validity Window: Spot spot-market quotes remain valid for 7 calendar days from issuance unless explicitly stated otherwise.

3. Shipper Warranties & Cargo Declarations

The shipper or consignor warrants and represents that:

• All cargo is properly packed, marked, labeled, and prepared to withstand standard multimodal transit conditions.
• Declared descriptions, weight tickets, and commercial invoice values submitted are accurate and in full compliance with Indian Goods and Services Tax (GST) e-way bill requirements and international customs statutes.
• Hazardous, dangerous, or restricted goods (IMDG/ADR/ICAO) are declared in writing prior to dispatch and accompanied by valid Material Safety Data Sheets (MSDS).

4. Detention, Demurrage & Storage Conditions

Standard free-time periods are provided for cargo loading, container turnaround, and warehouse consolidation. Beyond designated free periods, prevailing commercial tariff rates apply as follows:

• Free Warehouse Storage: Standard plans include designated warehouse consolidation days. Extended storage is billed at the transparent rate of ₹1,200 / Pallet / Week.
• Customs Formalities: Standard customs brokerage declarations are billed at ₹6,500 / Declaration, excluding statutory government duty levies.
• Vehicle Detention: Loading and unloading must be completed within agreed operational hours to prevent carrier detention charges.

5. Cargo Liability & Insurance Protection

JP Logistices exercises reasonable care and skill in handling all cargo. Liability for loss or physical damage during carriage is determined according to applicable statutory frameworks (such as the Carriage by Road Act, 2007, and Multimodal Transportation of Goods Act):

• Optional All-Risk Cover: Shippers may elect comprehensive cargo insurance protection at booking (0.35% of declared value) for full peace of mind.
• Claims Timelines: Any claim for visible external damage must be endorsed on the Electronic Proof of Delivery (e-POD) upon receipt and lodged in writing within 7 calendar days.

6. Force Majeure & Routing Integrity

JP Logistices is not liable for delivery delays caused by events beyond reasonable operational control, including natural disasters, port strikes, civil disturbances, severe weather blockages, or statutory regulatory embargos. If JP Logistices modifies a corridor route for internal operational efficiency, the quoted customer rate does not increase.

7. Governing Law & Dispute Resolution

These Terms and any commercial dispute arising out of freight services rendered shall be governed by and construed under the laws of the Republic of India. Courts situated in New Delhi shall hold exclusive jurisdiction.
